TERMS AND CONDITIONS FOR ALBANIA TRAVEL
1. Introduction
Albania Travel is an independent referral and information service based in Australia that connects potential Australian travellers with Wander Albania, a separate travel organisation, based in Albania. We do not sell travel services, handle payments, or make bookings. Our role is limited to:
- Providing information about travel in Albania and suggested itineraries
- Connecting interested travellers with Wander Albania
- Offering general guidance about travel requirements
We will not:
- Make bookings on your behalf
- Handle any payments
- Be responsible for any arrangements made between you and Wander Albania
- Be liable for any disputes between you and Wander Albania or other travel providers
But we will do our utmost to help you achieve the very best outcomes for your planning and preparation for your travels in Albania with Wander Albania by being available at standard Australian business hours.
These terms and conditions contain important information about what we do and your legal rights. You must not make any booking with Wander Albania or other travel organisations whose services are linked with your travel to Albania (e.g. airlines, ferries, cruise ships etc) unless you understand and agree with these terms and conditions. References to “us”, “we” and “our” mean Albania Travel, and “you” and “your” shall mean the client and the person(s) travelling.
By seeking information about travelling in Albania from us or making any subsequent booking with Wander Albania, you agree to comply with these terms and conditions whether your dealings with us are online, over the phone, by email or in person. We will rely on the authority of the person engaging with us to be acting on your behalf and on behalf of any other traveller on the same booking (regardless of whether other travellers have made separate bookings and payments) and that person will bind all such travellers to these terms and conditions. We are not required to enquire as to the authority of any of your representatives to provide information on your behalf.
2. Provision of information
Albania Travel will provide information to assist potential and actual clients of Wander Albania. We shall do our utmost to provide factual, accurate information and assistance to help clients gain the maximum benefit and derive the most satisfaction from making a booking with Wander Albania.
3. Bookings, changes and cancellations
Albania Travel will not make actual bookings for clients or take payments. All bookings and payments will be made by clients directly with Wander Albania or other travel organisations whose services you have engaged for your travel to Albania. For this reason, we shall not be liable for any disputes between you and Wander Albania or any other travel organisations. Wander Albania will be using travel service providers in Albania to provide many of the requirements of your booking. Each travel service provider’s terms and conditions are separate to our (these) terms and conditions.
Wander Albania will require you to pay a deposit or deposits when booking your travel and activities in Albania. Wander Albania will inform you of the financial impacts of any cancellation made by you in relation to the time interval between payment being made and the start of your travel. Final payment is usually required by a set date prior to the start of travel arrangements unless otherwise stated by Wander Albania. Be aware, some products and/or services may have to be paid in full at the time of booking. You will be responsible for all flights and transportation costs involved with getting you to Albania.
You must be aware that a change or cancellation of a booking by you may attract charges. Wander Albania may be coordinating travel arrangements with different travel service providers in Albania. As such, bookings made on your behalf by Wander Albania are subject to the terms and conditions of those travel service providers in Albania. If, for example, a travel service provider’s terms and conditions contain a ‘no refund policy’, Wander Albania will only be able to provide you with the remedy provided by the travel service provider (if any), and if successful, may be a travel credit supplied by the travel service provider. Albania Travel will help clients to achieve the best outcome by liaising with Wander Albania on your behalf in such circumstances, but we cannot be held liable for outcomes.
4. Pricing
Prices shown on the Albania Travel website are in Australian dollars which reflect the prices provided in either Albanian currency or Euros on the Wander Albania website. Due to currency exchange fluctuations and the potential for additional taxes or fees to be imposed by the Albanian Government at short notice, these prices are subject to change on both websites at no or very short notice. Be aware, prices can move up as well as down. Where achievable, prices will remain as constant as possible for as long as possible, and it will be normal for base prices to remain constant throughout a season.
To help clients have more certainty over pricing, Wander Albania will lock in prices after the deposit for their booking has been paid.
Children under 12 years old at the time of the booking will be charged 60 percent of the adult price.
Wander Albania reserves the right to defer confirming the price of long term bookings from being made more than 12 months before the first day of travel in Albania.
5. Travel insurance
Travel insurance is strongly recommended by the Department of Foreign Affairs and Trade (DFAT) for all overseas travel. We strongly recommend that you take out appropriate travel insurance to cover your travel arrangements. Your insurance protection should include cover for cancellation; medical and repatriation expenses; personal injury and accident; death; loss of personal baggage and money, and personal liability. Evidence of such insurances may be requested by us or Wander Albania and must be produced to us or them on request.
6. Travel documents
Incorrect travel documentation can delay or cause your travel to be terminated. Travel documents include airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic format or otherwise) used to confirm an arrangement with a travel service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable, and/or subject to cancellation and/or other change fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. Your name and the spelling of it on your passport, visa and other travel documents must be identical. An incorrect name on a booking may result in an inability to use that booking; the booking being cancelled, and possibly additional change and/or cancellation fees being raised. You must review your travel documentation carefully and advise us or Wander Albania immediately of any errors in names, dates, or timings.
Understand your allocated baggage allowances as these can vary from airline to airline and country to country. Excess baggage (if your airline allows it) can be expensive and any additional fees to be paid will be your responsibility.
7. Passports and visas
All international travellers must have a valid passport and, if necessary, depending on which countries you are transiting through, visas and re-entry permits which meet the requirements of immigration and other government authorities. Many countries require at least 6 months validity from the date your travel begins to your final or home destination. Some countries require a machine-readable passport. You are responsible for knowing and meeting the requirements.
If you are travelling via USA
See https://esta.cbp.dhs.gov for information regarding compulsory pre-registration for the US visa waiver program (ESTA). Australian passport holders will not be able to enter the USA without a valid ESTA (or visa). If you do not meet the eligibility requirements of ESTA you may be required to obtain a visa instead. For instance, if you have travelled to certain countries (including Iran, Iraq, Syria, Sudan, Yemen, Libya, Somalia, Cuba or North Korea) then you will probably not be eligible for the US ESTA and will have to apply for a US visa (which requires an interview appointment and can take several months to achieve).
If you are travelling via Canada
See http://www.cic.gc.ca/english/visit/eta.asp for information regarding compulsory electronic travel authorization for visa-exempt foreign nationals (ETA). Australian passport holders are not able to enter Canada without a valid ETA (or visa or permit). If you do not meet the eligibility requirements of ETA, you may be required to obtain a visa or permit.
8. Health
You must be aware of any health requirements and recommended precautions relevant to your travel booking and ensure that you carry all necessary vaccination documentation. In some cases, failure to present required vaccination documentation may deny you entry into a country. We recommend that you consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your travel. 9. Special requirements
It is your responsibility to inform Wander Albania of any unique requirements you may have for your travel arrangements such as special meals, dietary needs, seating requests, room types or disabled access, etc.
10. Travel advice including COVID-19 (Coronavirus) guidance
COVID travel requirements issued by governments, airlines and travel service providers are subject to change without notice. Before booking, after booking, and immediately before you travel, check the latest Australian Federal Government’s travel requirements. Visit the Australian Department of Home Affairs website for more information. Also check for additional health and safety protocols in response to not only COVID-19 but any new variants or medical/health concerns prevalent at the time or which may impact your travel.
We recommend that you contact the Department of Foreign Affairs and Trade (DFAT) or visit their website at www.smartraveller.gov.au for general travel advice, as well as specific advice (including safety alert levels) relating to the destination(s) you wish to visit or transit through. You can also register your travel plans with DFAT, so that you may be more easily contacted in an emergency.
It is your responsibility to acquaint yourself with all relevant travel information, including applicable health risks. Your decision to travel is made based on your own consideration of this information. You acknowledge and agree that you are aware of and assume responsibility for the risks associated with traveling.
11. Unavoidable or extraordinary circumstances
Travel to anywhere outside Australia can result in unexpected outcomes and that is why having travel insurance is essential. In the event of unavoidable or extraordinary circumstances, a travel service provider may materially modify or cancel all or some of your booking. In these terms and conditions ‘unavoidable or extraordinary circumstances’ means any cause outside a travel service provider’s reasonable control which could not have been prevented or avoided even if all reasonable measures had been taken by the travel service provider (including, but not limited to, war, threat of war, riot, civil disturbances, industrial dispute, terrorist activity and its consequences, plague, epidemic, pandemic, infectious disease outbreak or any other public health crisis (including quarantine or other employee restrictions), natural or other disaster (such as volcanic ash or hurricanes or similar events), nuclear incident, fire or bushfires, adverse weather conditions (actual or threatened, including snow and fog), closed or congested airports or ports or other modes of transport, unavoidable technical problems with transport, unforeseen alterations to transport schedules, transportation disruptions or cancellations, domestic and/or international travel restrictions, changes to travel advisories and restrictions, changes to health advisories and quarantines, changes to immigration, labour and free-movement laws resulting from political or economic changes, rescheduling of aircraft or boats or other modes of transport, changes to applicable laws and/or other government mandates (including evacuation orders and border closures), and similar events).
A material modification is one that has a serious impact on your booking and would cause substantial inconvenience to you (including a change of departure date, departure point, or change of departure time of more than twelve hours).
12. Cancellation due to unavoidable or extraordinary circumstances
If your booking is cancelled due to unavoidable or extraordinary circumstances, Wander Albania will work with their travel service providers to arrange a refund for you subject to the travel service provider’s change or cancellation policy. If that is not possible, Wander Albania will attempt to arrange a travel credit or a refund of all money paid by you for the booking less any unrecoverable costs and fees as raised by a travel service provider and/or Wander Albania.
13. Travel service providers
Your legal rights in connection with the provision of travel services are against the specific travel service provider providing services required as part of your booking, e.g. hire vehicles, accommodation, guides etc. The relevant travel service provider’s terms and conditions can generally be accessed on their country-specific website. If you would like any assistance to access any Albanian travel service provider’s terms and conditions, or if you are not sure which terms and conditions apply to your booking, please contact Wander Albania direct.
A travel service provider’s terms and conditions may include fees relating to booking cancellations or changes for reasons outside the travel service provider’s control. Their terms and conditions may also include penalties relating to cancellations or changes on your part, which may include cancellation or change fees.
Note, for instant purchase or non-refundable bookings, if you cancel any aspect of your booking, you may not be entitled to a refund, travel credit or other remedy from the travel service provider.
14. Liability
The liabilities described in these terms and conditions are subject to your rights under the Australian Consumer Law, if applicable to you. Nothing in these terms and conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth). However, be aware that all arrangements made by Wander Albania on your behalf are not subject to this Act.
15. Supplier or travel service provider insolvency
Without limiting Section 14 above, for the avoidance of doubt, in the event of Wander Albania or a third party provider being unable to provide you with the product and/or service you have booked due to that third party provider becoming insolvent or being placed under external administration, we have no obligation to reimburse you for the cost of your booking, or for any loss or damage you may otherwise suffer as a result of any such insolvency or external administration.
